Public Hearing

NOTICE OF PUBLIC HEARING

Pursuant to Idaho Code, the Planning and Zoning Commission of the City of Shelley hereby gives notice that a public hearing will be held on June 18, 2024 at 7:30 p.m. at the Shelley City Hall, 101 S. Emerson Ave., Shelley, Idaho.

The purpose of this hearing is to consider issuance of a special use permit to allow a single-family dwelling to continue use as a single-family dwelling in a Heavy Commercial (HC) zone upon sale of the property located at 370 N. State Street, Shelley, Idaho.   The legal description for this parcel of property is as follows:

Parcel 1

Commencing at the Southwest corner of Block 37 of the Replat of Shelley, Idaho, then North Zero degrees and 27 minutes East, along the West line of said Block 37, for 14 feet, more or less, to the East and West Sixteenth line through the center of the Southwest Quarter of Section 28, township 1 North, Range 37, East Boise Meridian, then South 89 degrees and 48 minutes East, along said East and West Sixteenth line, 24.2 feet, more or less, to the West right of way line of the State Highway #91 and #191, then North 29 degrees and 21 minutes East, along said State Highway right of way line for 483 feet to the true point of beginning; thence North 29 degrees and 21 minutes East, along said State Highway right of way line, 100 feet; thence North 60 degrees and 39 minutes West, 280 feet; thence South 29 degrees and 21 minutes West, 100 feet; thence South 60 degrees and 39 minutes East, 280 feet to the point of beginning, containing .64 of an acre, more or less, begin part of Block 37 of the Replat of Shelley, Idaho.

Parcel 2

Beginning at a point that is S 89° 15’ 45” E 650.14 feet and S 00° 14’ 32” W 638.32 feet from the W ¼ corner of Section 28, Township 1 North, Range 37 East of the Boise Baseline and Meridian and Running thence S 00° 14’ 32” W 113.44 feet; thence S 60° 27’06” E 9.39 feet; thence N 29° 32’ 54” E 3.61 feet; thence N 29° 34’ 51” E 95.55 feet; thence N 60° 39’ 23” W 64.97 feet to the point of beginning.  Parcel contains 0.08 acres.

Parcel 3

The West 64.6 feet of the East ½ of Lot 1 in Block 32 of Dawson Addition to the city of Shelley, Bingham County, Idaho, according to the plat recorded in Book 3 of Plats, page 80, records of said county.

Public Hearing

NOTICE OF PUBLIC HEARING

Pursuant to Idaho Code the Planning and Zoning Commission of the City of Shelley hereby gives notice that a public hearing will be held on June 18, 2024 at 7:30 p.m. at the Shelley City Hall, 101 S. Emerson Ave., Shelley, Idaho.

The purpose of this hearing is to consider amending Title Ten of the City of Shelley Ordinances.  More specifically is to consider amending 10-8 and several sections of 10-16 along with adding additional language:

10-8-6(D)(2):  Amend from a 30 ft. wide finished private driveway to a 30 ft. wide total frontage with 20 ft. wide being finished material.

10-16-5: Add language stating if building commences prior to all improvements being completed and accepted by the city then no certificate of occupancy will be issued until acceptance by the city.  Also to add that no lot shall be sold until the plat has been recorded in the office of the County Recorder.

10-16-6 (D)(2):  Correct an error stating a pedestrian easement shall be at least ten (1) feet wide.  Should state (10).

10-16-6(F):  This will add more specific regulations regarding planting strips, landscaping, buffers, and screening that will be required in subdivisions.  This will identify landscaping materials, maintenance, a requirement of a landscape plan, and minimum landscaped setback contiguous to a street.  (More detailed specifics are available at city hall).

10-16-9:  To amend the language to require 3 copies of a preliminary plat instead of 6 and also correct an error from sixty (6) to (60).

10-16-14 (E) (3):  Amending the language stating the final plat will be recorded prior to constructing any infrastructure.

10-16-14 (E) (5): Amending the review period of “as-built” plans from 10 days to 30 days.

10-16: Addition of inspection language to require compliance with the latest version of the ISPWC (2020) General Conditions, Standard Specification, and Standard Details.  Also, to include preparation of daily reports, bi-weekly progress meetings, and competent licensed engineer to observe and inspect work to confirm compliance with ISPWC requirements. More information is available for review at City Hall, 101 S. Emerson Avenue, Monday through Thursday from 8:00 a.m. until 5:30 p.m. and Friday from 8:00 a.m. until noon.
